Who is and is not a ‘paramilitary’? Erasing the changing nature of Colombia’s conflicts over land

A few weeks ago, Al Jazeera English’s “Fault Lines” program recently ran an interesting 20-minute investigative piece on the struggles of community leaders with respect to the Land Restitution process, which raises some questions about whether or not paramilitarism continues, or has changed in Colombia.

Some context The Paramilitary Demobilization & Contested Narratives.

Since the 1920s (and arguably, since the 16th century), disputes over who owns land, whether land can be ‘owned’, who gets to benefit off of the land, have been deeply influencing Colombia’s armed and social conflict.

Although the FARC, the ELN, drug cartels, and the army/all armed actors in Colombia have displaced people off of their land and terrorized communities in order to exert social and territorial control over them, right-wing paramilitary groups working often on behalf of narcotraffickers and large land owners have been particularly tied to the question of displacement. Colombia is said to have the highest number of internally displaced people in the world (the Norwegian Refugee Council puts it at 5.5 million, and this documentary puts it at around 6 million). This is not  even counting those who were displaced outside of Colombia. Many in Colombia say that throughout the war, as much as 10 million hectares have changed hands.

What’s interesting here is that many analyses concerning Colombia’s Land Restitution Law follow a common, and relatively accurate, narrative – Colombia’s land restitution process is at serious threat because of the continued threats by armed groups to community organizers leading land claims. However, the Al-Jazeera documentary probes deeper into the ideological and semantic questions of these threats, which arguably, are of tremendous significance to the political moment in which the land restitution process occurs.

Firstly, the confederation of right-wing paramilitary groups known as las Autodefensas Unidas de Colombia (AUC, or the United Self-Defense forces of Colombia) demobilized in 2003-6 in a highly-criticized process which some victim’s groups saw as a granting of impunity    Many of the middle-rung paramilitary leaders who demobilized under the law (and were not extradited to the United States on drug trafficking charges) will start to be released this year.

Thousands of the former paramilitaries granted legal benefits under the demobilization process with the previous government of Alvaro Uribe (2002-2010), re-armed into groups that have been characterized by the government and some analysts as “criminal bands” or BACRIM, or armed groups that are primarily focused on narcotrafficking, and not actors in the armed conflict.

In the documentary, a functionary of the national government says that the BACRIM are not paramilitaries, for example, because they do not engage in combat with the FARC or the ELN.

Others, such as opposition Congressman Ivan Cepeda have argued that the BACRIM are neo-paramilitaries, or a continuation of powerful interests defending themselves with private armies. What is undoubted is that the human costs of paramilitarism, and the tactics of repression, threats, and cruelty imposed by these groups on the civilian population are very similar to the ‘old’ paramilitaries and are devastating. It is important to note however that the ‘old’ paramilitaries in the 1990s committed many large, atrocious massacres, and these are much less common now, although the selective murders of activists continue at an alarming rate in Colombia. It’s also worth nothing that violence perpetrated by the neoparas/BACRIM accounts for the majority of forced displacement currently.

At the heart of the question is what is the ideological motivation (if any) behind these paramilitary successor groups – if they have, like the Castaños – a clear anti-subversive, right-wing and seemingly fascist ideological motivation, or if they are “merely” criminal groups or drug traffickers and pistols-for-hire for powerful landed interests. This raises some questions about history – one of Uribe’s main challenges in beginning negotiations with the AUC in the early 2000s was that to do so they needed to have legally recognized political status (which they did not). Moreover, some have argued that even the AUC did not necessarily have a coherent guiding ideology as many groups were the private armies of (seemingly apolitical) narcotraffickers. However, in relation to land, it is clear that the AUC did have a clear pro-business, pro-land owner and anti-dissident agenda.

“Neoparamilitarism” in the Current Political Moment – Moving toward “peace”?

The important point here is the political interests behind this seemingly abstract distinction – if the they do have an ideological motivation, then perhaps the “neoparas” are a continuation of paramilitarism in Colombia, but if they are not, this validates the official discourse that paramilitarism in Colombia ended in 2006 with the demoblization of the AUC. Under this logic, which is the government narrative and is often reproduced in Colombian media, the only groups left to negotiate with for “peace” in Colombia are the guerrillas.

Within this narrative is the conjecture of the “historic” 2011 Victim’s and Land Restitution’s Law and the current peace talks with the FARC guerrillas in Havana. Both initiatives by the Santos government are aimed at ending Colombia’s conflict (although, a conflict defined in certain ways) and providing ‘reparations’ for “moving forward” or establishing a so-called “peace”.

Although the Victim’s Law is a useful tool and has some interesting mechanisms for Victim’s (such as a reverse-onus for land-owners accused of having ‘dirty’ land to prove that they obtained it legally), the law, as explained by the Al-Jazeera documentary, is actually quite tepid in how much land can be redistributed, and in how much time (the law stops after a decade, and the backlog on land claims is enormous). Furthermore, according to one interviewee, the law won’t touch the land of large companies or land-owners who have their paper work in order. In other words, the Victim’s Law is not an agrarian reform to respond to not only the violent, largely paramilitary and narco-trafficker-driven, counter-agrarian reform/displacement crisis of the last 30 years, but it also leaves out the historic question of land inequality in Colombia (rooted in colonialism). Finally, there are questions about whether those displaced by the BACRIM/neo-paras (as these aren’t deemed as political actors in the armed conflict) will be eligible for restitution.

Therefore, the political categorization of Colombia’s armed groups in institutional and political terms shapes conceptualizations of the conflict, and subsequently, divergences between how the state wants to frame the war (or ignore it) and how people experience it in human and material terms (killings of leaders continue, land isn’t given back).

Ideologically, the Colombian state, the international community, and particularly academia, seems to prioritize political violence (as this threatens the state, and is more “sexy”/associated with mass and sensationalized violence). Prioritizing this violence also prioritizes its victims. However, that begs the question – what is an armed conflict, what is political violence, and what does it matter? Arguably, Mexico is currently experiencing a brutal civil war.  Politics also currently colours the mass wave of violence in Venezuela, which in recent years has had some of the highest murder rates in the world.

It makes little senses to create a hierarchy of violences, and of  its’ victims, according to rigid and problematic intellectual definitions of an ‘armed conflict’ needing to have a certain relationship to discourses (groups needing explicit political goals) and to the state (protecting or challenging its monopoly on violence).

Kyle Johnson in a guest piece over at Colombia Reports on the “neo-paras” offers a much more useful conceptualization:

The political at its root is the capacity to make and implement decisions that define, normally limiting, the rules of the game in society by imposing restrictions and permissions on certain actions; it is looking to establish a social hierarchy and decide who resides where in that hierarchy; usually the rules and hierarchy are reinforced through coercion and selected benefits for certain sectors of the population. This definition is far from most arguments about what constitutes political positions, political interests, etc. It is derived from classical political theory and some sociological concepts on political power, and it should be noted that one does not need a clear, well-developed ideological project to have a political side.

Given the incredible historical importance that land has played in establishing the position of people in the regional social hierarchy, and thus the economic, social and political power large landowners have, the threats and violence against those who are reclaiming their stolen land back are effectively defining the place of certain actors in that hierarchy. …

Additionally, these coercive actions indicate that looking to gain stolen land back is not permitted in the areas under Urabeños’ control.

So in the Colombian context (and many others) the contention that is politics is largely rooted in land, and therefore the BACRIM/neoparamilitaries are definitely political actors as they are trying to close political space for actors wanting to claim it, using a language of ‘cleansing’ that harks back to the days of the AUC.   They also  seem to be in favour of business interests and against activists/community leaders and progressive sectors.

By re-defining the nature of politics to be something broader than explicit ideology or threats to the state, and armed political conflict, or by not creating a hierarchy of victims, hopefully this would open more institutional spaces for victim’s to have access to memory, reparations, justice, and restitution on their terms. However, as things currently stand, questions of whether paramilitarism continues in Colombia are seemingly being ignored by the state and some sectors of the media in their language and characterization of paramilitary successor groups as ‘criminal bands’ disconnected from the past paramilitaries. What the thesis of ‘neoparamilitarism’ does is throw a wrench in the the assumptions behind the Land Restitution process, the peace process, and notions of transitional justice in Colombia : the Justice & Peace Law was not just an abject failure in providing justice, but it also provided no peace and no transition. At a local level, conflicts over land continue in the same nature as during the height of the war and paramilitarism/paramilitarism was not stopped by the demobilization.

Validating the official discourse – that paramilitaries are over, land is being given back, and soon, the guerrillas and the war in general will be history, erases not only the current lived experiences of people in regions like Jiguamiando and Curvarado and the Urabá region, but also more structural, historical, and political underpinnings of Colombia’s conflict (land inequality and the brutal repression of peaceful dissidence). It also erases how Colombian democracy was shockingly co-opted by paramilitary groups, and that the alliances between certain businesspeople, politicians, and armed groups who displace and threaten peasants, Afro-Colombians, popular sectors, and indigenous people are something that has been overcome.

In other words, at this course, violence against Colombia’s peasantry will long continue after the FARC give up their arms, but the victim’s of Colombia’s war will be even more invisible; the war will be further denied.
PS – The International Criminal Court is looking at one paramilitary group, the ‘Autodefensas Gaitanistas de Colombia’, popularly referred to as “Los Urabeños“.

Justicia apurada, justicia negada? Una importante noticia sobre el proceso de justicia y paz/justicia ‘transicional’

Desde inicios del año pasado, la Fiscalía decidió cambiar la estrategia de Justicia y Paz, y darle prioridad a los casos contra 16 de los principales ex jefes paramilitares y guerrilleros postulados al proceso para poder conseguir sentencias definitivas en un menor plazo. Con la estrategia original, que pretendía juzgar a más de tres mil postulados a Justicia y Paz caso por caso, según ordenaba la Ley 975 antes de que fuera reformada, el cálculo daba que tomaría casi un siglo terminarlos, una contradicción en sí misma pues se trata de una justicia transicional. De ahí que se haya reorganizado el trabajo de la Fiscalía para sacar adelante inicialmente 16 macro-procesos – reducidos ahora a 13 para la etapa de juicio – encabezados cada uno por un ex jefe de los grupos armados que está postulado a Justicia y Paz, con el objetivo de que éstos terminen en 16 sentencias colectivas para ellos y quienes fueron sus subalternos, y en reconocimientos, colectivos también, a quienes fueron sus víctimas.

La meta de junio de este año no es gratuita; en ese mismo mes muchos postulados, incluidos jefes paramilitares, podrían comenzar a solicitar su libertad porque cumplen los ocho años de prisión, la pena más alta a la que pueden ser condenados en Justicia y Paz. El nuevo método consiste en que primero la Fiscalía hace las imputaciones contra los postulados (las acusaciones por sus delitos) en audiencias preliminares frente a los Tribunales de Justicia y Paz, y luego, comienzan las audiencias concentradas, en las que se expone de una manera más detallada los hechos o crímenes por los que son juzgados los postulados; después, el incidente de identificación de afectaciones causadas a las víctimas, y termina con la sentencia y las posteriores audiencias de cumplimiento.

Hasta el momento, tres de esos procesos están por entrar a la última etapa de “audiencias concentradas”. Otros nueve macro- procesos se encuentran un paso atrás, en las “audiencias preliminares”, y los demás están en etapas anteriores.

El 9 de diciembre del año pasado, Juan Pablo Hinestrosa, director de la Unidad de Justicia y Paz de la Fiscalía, defendió en una rueda de prensa el trabajo de la institución: “en junio de 2014, postulados como Fredy Rendón Herrera, alias ‘El Alemán’, y otros postulados de mayor y menor rango van a quedar libres por el vencimiento de sus penas cumplidas. La apuesta que hace la Fiscalía desde que empezó esta administración es lograr que cuando empiecen a quedar libres estos postulados se tengan sentencias condenatorias para así cumplir con lo que se llama Justicia Transicional”, explicó.

La justicia transicional colombiana, que se ha aplicado en varios países como una manera de dejar atrás la guerra, buscó suspenderles las condenas por sus múltiples delitos atroces a aquellos paramilitares y guerrilleros que se comprometieron a dejar las armas en forma colectiva o individual, e imponerles penas de máximo ocho años de cárcel, a cambio de que colaboraran con la justicia, la verdad y la reparación de sus víctimas. Y este año se cumple esa pena máxima de ocho años para muchos de ellos.

VerdadAbierta.com consultó a fiscales, abogados de postulados y de víctimas que participan en el proceso y coincidieron en que no es muy probable que se consigan fallos condenatorios de los postulados y sus subalternos en los cinco meses que faltan. Además, algunos de ellos advirtieron que no sólo importa la celeridad con que se adelanten los procesos, si no que se cumplan los principios generales de la Ley de Justicia y Paz de responderle a las víctimas y a la sociedad con verdad y justicia y una reparación debida.

Las cuentas
Hasta diciembre del año pasado se habían realizado las imputaciones contra nueve de los postulados. Cada una de estas imputaciones incluye la descripción de la larga lista de crímenes que confesaron los ex paramilitares o ex guerrilleros y su grupo o que el fiscal del caso documentó, según los tipos de delitos que Fiscalía fijó como prioritarios. Estos son: violencia sexual, desplazamiento forzado, desaparición forzada, reclutamiento de menores y casos de connotación, que son delitos seleccionados por el fiscal de cada grupo como masacres, secuestros, extorsiones a gremios regionales u homicidios de minorías o líderes de la comunidad.

Los procesos que van más avanzados son los de las Autodefensas Campesinas del Magdalena Medio, el del comandante del Frente 43 de las Farc, ‘Martín Sombra’, y el del Ejército Revolucionario Guevarista. Las audiencias concentradas están fijadas para el próximo 20 de enero en los tribunales de Justicia y Paz de Bogotá y Medellín.

La diligencia que hasta el momento más retrasos presenta es la de Diego Fernando Murillo Bejarano, alias ‘Don Berna’, que iniciará el 27 de enero con la imputación de cargos por su participación como comandante de los Bloques Héroes de Granada, Héroes de Tolová y Cacique Nutibara. Al hacer los cálculos hay que considerar que la Ley 1592 de 2012 que reformó la Ley 975 de 2005 o de Justicia y Paz, no establece ningún tiempo límite de duración de las audiencias preliminares y la concentrada. Los únicos plazos establecidos son los de los intervalos entre la finalización y el inicio de una nueva etapa.

A mediados del año pasado, cuando se anunciaron los primeros avances de la estrategia de priorización, la Fiscalía había anunciado que el 31 de julio de 2013 tendría radicados los escritos de imputación de cargos para que los magistrados establecieran la fecha de inicio de las audiencias. Sin embargo, los cálculos eran optimistas para el volumen de trabajo que esto implicaba y los fiscales sólo pudieron terminar estas imputaciones entre octubre y diciembre o apenas están por terminar. Un fiscal le explicó a VerdadAbierta.com que las audiencias concentradas podrían tardar un poco más que las imputaciones, pues la formulación de cargos es más detallada. “Se abordan todos los casos con más profundidad –explicó –, ahí debe quedar muy claro quiénes fueron los autores y si fueron materiales o no, y presentar todas las circunstancias de tiempo, modo y lugar”.

Infraestructura
Uno de los problemas que más llama la atención de los defensores de los postulados y las víctimas es la escasa infraestructura y personal con la que cuenta la justicia para hacer esta inmensa tarea. La mayor parte de la responsabilidad para dictar esas 16 macro-sentencias recae sobre los seis magistrados de conocimiento de Justicia y Paz con los que cuenta el país (cuatro en Bogotá, uno en Medellín y uno en Barranquilla). Los fallos hasta el momento se refieren a 11 mil hechos que comprometen a 34 mil víctimas. A esto habría que agregar las demás diligencias que se derivan de los casos de otros postulados y estructuras guerrilleras y paramilitares que no han sido definidos como prioritarios, pero que aun así deben continuar.

Sobre esto, el director de la Unidad de Justicia y Paz, citó al Fiscal General de la Nación, Eduardo Montealegre, en una intervención que había hecho meses atrás diciendo: “señores Magistrados, el balón está en su campo, de ustedes depende que podamos sacar esta sentencias condenatorias antes de junio de 2014. De ustedes depende que este esfuerzo macro de la Fiscalía, Unidad de Justicia y Paz, no sea inocuo, que no estemos arando en el mar. Que realmente podamos mostrar que en Colombia no nos quedó grande la Justicia Transicional y que estamos en la Fiscalía General de la Nación, preparados para recibir un eventual proceso de Justicia Transicional que llegare de La Habana. Estamos demostrando que la política de priorización es un hecho, es un éxito. Que hemos cumplido, nos falta mucho por hacer, pero que lo que primero hicimos fue fijar una estrategia para poder evacuar en mayor medida toda esa cantidad de hechos y de víctimas que están reclamando justicia”.

No obstante, el trabajo de investigación de varias decenas de equipos de fiscales debe ser evaluado y sopesado por pocos magistrados con equipos de trabajo pequeños, para poder conducir adecuadamente la etapa de juzgamiento y dictar sentencia. Como dijo un abogado de uno de los postulados, “los magistrados no tienen el don de la ubicuidad”.

Explicó que “el deseo de todos es tener las sentencias, pero si uno ve el proceso desde la infraestructura es complejo, hay mucha distancia de lo que se quiere a lo que ocurre”. Además dijo que se requiere que colaboren también otras entidades como el Inpec, y las otras partes que participan del proceso. No obstante las dificultades, aseguró que “desde la metodología que se implementó con la priorización, en el último año por lo menos se logró algo que no se había obtenido desde el 2005: en un día se imputaron 300 hechos”.

Los aplazamientos han sido una de las causas en los retrasos de las audiencias. En los meses anteriores, entre julio y diciembre del año pasado, en los que la Fiscalía había programado la etapa de las audiencias preliminares, se han presentado retrasos por diferentes motivos que van desde problemas en el transporte de los postulados desde las cárceles, excusas médicas por parte de los postulados hasta simples trámites jurídicos o administrativos.

Otro jurista que defiende a un ex jefe paramilitar extraditado a Estados Unidos expresa que para este año también hay que corregir los problemas logísticos que se presentaron en etapas anteriores. Relata que hubo retrasos de días o semanas porque los dispositivos para hacer las videoconferencias se dañaban o el Inpec fallaba en el traslado de algunos postulados.

Una defensora de víctimas de varios procesos de Justicia y Paz, entre ellos el del Bloque Central Bolívar, coincidió con las contrapartes en que los magistrados son muy pocos para tantas sentencias.

La meta
Esta misma abogada advierte, sin embargo, que “no se trata de afanarse para mostrar resultados. La eficiencia y la eficacia no pueden ir por vías distintas. La celeridad no puede recortar la esencia de Justicia y Paz, es decir, debe quedar claro que para reparación debe haber verdad, y no hay verdad si no hay justicia”.

La defensora también señala que “las víctimas están esperando que desde hace 10 o 20 años se les cuente la verdad. Lo que puede salir en junio son sentencias parciales, es decir una verdad parcializada. Porque los delitos priorizados excluyeron en algunos casos torturas, secuestros o robos. Y antes de que una víctima fuera asesinada, años antes había pasado por todo eso. Hay que tener en cuenta la reparación”.

El abogado del ex jefe paramilitar manifiesta que “estoy de acuerdo con la Corte cuando dice que es imposible llegar a una verdad absoluta del conflicto. Pero estas macro-sentencias deben contar la verdad para garantizar la no repetición. Hay víctimas que a pesar de contar ya con las sentencias, no han sido indemnizadas después de un año, y también hay temor entre los postulados que después de tanto tiempo queden libres y no quede muy clara su situación. Hay que pensar desde ahora en las seguridades jurídicas”.

Hasta este punto del proceso es claro que lo que falta para terminar es bastante: de cuatro partes del proceso de juzgamiento se ha avanzado parcialmente en la primera y faltarían otras tres, que en la práctica serán más extensas. El reto de alcanzar las 16 macro-sentencias anunciadas por la Fiscalía en el tiempo en que se lo propuso y, al mismo tiempo cumplir con los requisitos de la Ley de Justicia y Paz, recae casi completamente sobre los hombros de magistrados y fiscales.

No obstante, la responsabilidad de que esta se logre se extiende a diversas entidades que intervienen en el proceso. Por ejemplo, tan solo que un postulado no vaya a una audiencia programada porque el Inpec no hizo el traslado, o que no se haga una transmisión de una audiencia ente víctimas en un lugar remoto por razones técnicas, puede retrasar un caso varias semanas.”

Colombia: The Only Risk Is Having To Stay – Canadian Mining in the South of Bolívar and the Release of Jernoc Wobert

On Tuesday, August 27, Jernoc Wobert was freed by Colombian guerrillas. The Canadian geologist and Vice-President of Braeval Mining Co. had been kidnapped by the National Liberation Army (or El Ejército de la Liberación Nacional, ELN). The ELN had kidnapped him seven months ago with 3 other Colombians and 2 Peruvians.  The Latin Americans were released a few weeks after they had all been taken from Norosí in the Serranía de San Lucas in the south of Bolívar, but the Canadian remained.

As a condition to his release, the ELN demanded that the Canadian and Colombian government investigate the company in question for having allegedly taken land illegally from communities in Bolívar. On the other hand, the Colombian government, who has been negotiating a peace deal with the largest rebel group (the FARC), since November, predicated any negotiations with the ELN on his release. The ELN had previously expressed interest in negotiating with the national government, and the FARC had called on the government to also negotiate with the second largest guerrilla group. A few months ago when the eleños tried to enter the peace talks in Havana, they were turned away. Today, President Juan Manuel Santos announced that “everything is ready” for talks with the ELN.

Wobert’s release by the ELN to the International Committee of the Red Cross (ICRC, who is a neutral party in most high-profile hostage hand-overs in Colombia), was seen as a “humanitarian gesture” on the part of the rebels in order to demonstrate good faith in what could be a peace process. However, Wobert’s kidnapping (and release) are actually microcosms of much larger dynamics of the Colombian armed conflict, and of the mining investment that largely defines Canada’s relationship to Colombia.

Who are the ELN?

The ELN began in the early 1960s by radical University students who organized peasants. They were inspired by Marxism, the Cuban Revolution, and Liberation Theology. The ELN, unlike the FARC, actually have been slow to get as involved in drug trafficking. Nevertheless like the FARC, they commit crimes against humanity and war crimes such as kidnapping and killing civilians, recruiting minors/practicing forced conscription, planting land mines (which is against the Ottawa Treaty) and forced displacement. However, the ELN are most well known for their attacks against infrastructure (particularly attacking oil pipelines), which have increased this year. They are Colombia’s second largest guerrilla group.

The ELN’s political discourse and military actions against multinational investment in Colombia, particularly in the extractive sector, is part of what scared foreign investment away during much of the 1990s when guerrillas retained significant control over large parts of the country.  Like the FARC, The ELN would charge “revolutionary taxes” on businesses (vacunas), threaten and kidnap large-land owners and company executives, and would carry out infrastructure attacks.

A significant proportion of the counterinsurgency campaign of the paramilitaries and the army directly preceding and during the government of ex-President Alvaro Uribe Vélez (2002-2010) was to “pacify” regions so as to make them safe enough to encourage foreign investment. For example, a main focus of Plan Colombia was securing the Limón-Coveñas oil pipeline which had been attacked on several occasions by the guerrillas.

The ELN is currently in dire straits; it was weakened by the counterinsurgency much more than the FARC and they have currently between 2-3,000 fighters. There are few parts of the national territory  where they are the dominant armed group (oil-rich Arauca, for example), and many see the ELN now as a spent force who is desperate for a negotiated settlement out of the armed conflict.

The Serranía de San Lucas, where Wobert was taken, has been disputed by the ELN, the army, and the paramilitaries for decades given its geostrategic significance.  Over at the Tyee, Colombian journalist Sebastian Salamaca writes:

“[The ELN] decided a good place to start a revolution was the Serranía de San Lucas. Its rugged geography and lack of state presence made it ideal for organizing and gathering strength.

It took 20 years for them to control the area. By the 1980s, the ELN dominated the region. Their mixture of Marxism, liberation theology, and community activism helped them win the partial support of the population. They also regularly violated international law by blowing up pipelines and taking hostages.

In the late 1990s the ELN faced a potent foe, as Carlos Castaño, head of the far-right paramilitary forces in Colombia, or AUC, made it his obsession to take back the territory from the guerrillas.

The AUC knew about the strategic importance of the Serranía: whoever controlled it would profit from the massive cocaine traffic to the Caribbean and the huge gold deposits that were being discovered. Moreover, seizing the Serranía would ensure access to the largest watercourse in Colombia, the Magdalena River.”

What is Canada’s history in the South of Bolívar?

In an earlier post I remarked how the Canadian government, through funding the Canadian Energy Research Institute, helped re-write and liberalize Colombia’s mining code in 2001.

In Francisco Ramírez Cuellar’s “The Profits of Extermination”, he also outlines how in the Serranía de San Lucas in the South of Bolívar, in land that was initially titled to a local elite family, over 90 mining associations started to work the land through artisanal practices. Under Colombian law, if land is unused by the owner but is being used by someone else, technically, artisanal miners for example have up to two years to ask for titles to that land. Around the early 1990s, a Canadian mining company (then called Conquistador mines) became interested in the gold-rich area.

According to Ramírez, they hired a lawyer to negotiate the land with the small-scale miners on behalf of the Illeras-Palacios (the family who claimed the land). This same lawyer, interestingly, helped draft the 2001 mining code with CERI. After a visit from the Minister of mines, the artisanal miners backed away from negotiations and they gave the land to the mining company.

In 1997, the paramilitaries of the Peasant Self-Defence Forces of Córdoba and Urabá or the ACCU, who would later become the AUC, came to the Serranía. Their stated reasons for doing so were to control the mines, to get rid of miners who were “collaborating with the guerrillas”, and “guarantee the entrance of multinationals who would create jobs”. The paramilitary incursion destroyed over 10 towns in the region, massacred over 400 people, raped both men and women, and left several supposed “guerrilla collaborators” dismembered. Until 2008 over 94,000 people were displaced from the region because of the violence.

It is also worth noting that the Congressman representing the region at the time of the deal and the drafting of the new mining code has since been investigated for having ties to paramilitary groups.

Braeval and Conquistador mines are not the only Canadian companies with interests in the south of Bolívar. B2Gold, a Canadian gold company in the region, claims that it can only operate there with guarantees of security from the Colombian army. As mentioned in a report by Interpares and Mining Watch Canada, the Vice-President of B2Gold has said that non-indigenous communities have no right to reject mining projects on their territory, and alarmingly, that FEDEAGROMISBOL had been “contaminated” by guerrillas. As any student of Colombian history will know, these kinds of accusations can lead to violence against FEDEAGROMISBOL by state security and paramilitary forces (which is what has occurred).

What do the locals think? 

This informative report from Colombia Informa which interviewed community members and associations in the south of the Bolívar state gives an idea into what perceptions were on the ground of the kidnapping and the release of the Canadian executive.

The Agro-Mining Federation of the South of Bolívar (FEDEAGROMISBOL) is an umbrella organization which represents 34 associations of small-scale farmers and artisanal miners in the region has for years been stigmatized as being sympathetic to the guerrillas by the army and the paramilitaries (and has consequently suffered violence against its members). Nevertheless, the group actually had put out a communiqué which rejected the kidnappings carried out by the ELN of the miners and emphasized the release of the Colombians who appeared to be members of FEDEAGROMISBOL. They also said that the kidnappings were “a direct consequence of the indiscriminate natural resource exploitation policy  promoted by the Colombian government, affecting the south of Bolívar and of the handing over of our natural resource to large transnational capital”.

The locals they interviewed emphasized how the kidnapping of the Canadian by the ELN made life more difficult in the region as it invited increased repression from the government security forces. Some community members say that they supported the actions of the ELN, as it “halted the [government’s] mining development plans”, and who felt that this development plan is more for the benefit of multinational companies than their communities who have always been marginalized by the national government.

Other community members expressed their opposition to the kidnapping, saying that it furthers the stigmatization of local community organizing as being complicit or supportive of the guerrillas. Others mention how one of the reason two FEDEAGROMISBOL members were kidnapped was because they were helping the foreign miners behind the backs of the community.

Other community members mention how FEDEAGROMISBOL was able to win more than 10,000 hectares of land from the Lleras-Palacios (the local elite family mentioned earlier) through “pure social struggle”, but that speaking out was extremely difficult given the intense military and paramilitary repression to community organizing and dissidence.

Why was Wobert kidnapped and why does it matter?

Whereas the Colombians and the Peruvians were let free relatively soon, Wobert was kept by the ELN until Tuesday (he had been kidnapped since January), because he could have been a bargaining chip at any eventual peace talks (or even, the key to starting a dialogue). At the same time, the ELN rejects the presence of foreign extractive companies in Colombia, who they see as imperialists, and therefore wanted to retain Wobert until Braeval gave up its mining titles in the region.

Braeval actually has since renounced its four titles in the region; the company’s press release however did not mention the kidnapping.

The ruthless paramilitary expansion in the early 2000s in the region left many with the impression that the region had effectively been pacified, and that although in the most remote areas the ELN remained, the Serranía was perceived to be relatively safe for investment.

Despite the fact that a Colombian government report study which says that industrial mining should not occur in zones of armed conflict (such as the Serranía) junior-based mining companies (who are often Canadian, and are the most likely to take on very risky projects) continue to explore Colombian communities that exist in a context of extreme physical and social vulnerability.

The Canadian government, with its naming of Colombia as a priority for CIDA aid, and the Canada-Colombia Free Trade Agreement (CCFTA), is keen on having a stable (or “pacified”) Colombian countryside in which our companies can extract resources without being threatened. By the same token, the government of President Juan Manuel Santos has made resource extraction a pillar of his national economic development strategy. Wobert’s kidnapping is  a reminder that despite the strength of the paramilitaries and the Washington-funded Colombian army, the guerrillas, despite their losses, can still be a threat to multinational investment, and that Colombia is not as “safe” or “open” for business as it might seem. Kidnappings did not end with Uribe’s “Democratic Security”, and they probably won’t end with Santos.

The logical inverse of this premise (that the guerrillas are still a threat to investment), is that more pacification/repression of the guerrillas is necessary. Indeed, when Wobert was kidnapped, the Colombian government responded by sending 600 troops to the region. Wobert’s kidnapping reminds us that the steps of foreigners in Colombia’s most fragile and violent parts may provoke actions and counter-reactions by armed groups looking to show their dominance in any given region. And more of then than not, these struggles will take place on the backs of civilians (and sometimes in the name or interest of investment). As this Semana report notes, they allege that some companies have signed security/protection deals with the Colombian army, and that artisanal mining opponents to the investment of multinationals, particularly members of FEDEAGROMISBOL, have been systematically murdered.

Therefore, in this context, it must be asked whether Canadian mining investment in Colombia is worth the risk both that it poses to the Canadians who go to Colombia in search of resource riches, but more importantly, to the Colombians who call those communities home and ultimately have to live with the consequences of the instability and repression that mining investment might provoke.

Making A Killing: Colombia and the Canadian Military Industrial Complex

A few months ago, I wrote to the Canadian Minister of Foreign Affairs and International Trade, John Baird about Canada’s decision to allow Canadian weapons manufacturers to sell arms to Colombia. Baird had put Colombia on the Automatic Firearms Country Control List (AFCCL),  a list of now 34 countries to which Canadians can get export permits for weapons. The weapons which Canadian businesses would now be able to export to Colombia, actually aren’t even legal in Canada (see below).

In a brief and polite response, Baird informed me there had been “broad consultation” with the Canadian public and  and different government departments which had informed the decision. Apparently, the consultation touched on “multiple issues” including human rights, peace, stability, the risk of diversion, and interestingly, “commercial opportunities for Canadian business” (emphasis mine).

To Baird’s credit, he did mention that each export permit is assessed individually, with particular emphasis on what the “end-use” of the weapons will be, and if they are in accordance with Canadian foreign and  defense policy, law, and “including the potential impact of export on human rights and armed conflicts”.

At the end of his correspondence, Baird listed off a myriad of highly problematic initiatives as part of Canada’s relationship to Colombia, perhaps trying to show some sort of misguided intentions to “help” Colombia; in particular Baird lauded the Canada-Colombia Free Trade Agreement (FTA), and how Colombia has received benefits from DFAIT’s “Counter-Terrorism and Anti-Crime Capacity Building” programs.

 

Clearly all of these policies, but particularly for now the AFCCL, are very concerning and merit their own analysis. The larger point here is, despite Baird taking the time to reply, the decision of what will be a “risky” sale of weapons of mass destruction (automatic weapons)  to a country experiencing armed conflict and endemic levels of violence will be decided in Ottawa, with “commercial” interests in mind. This is all working under the militarist assumption that a country having a militarized society, or an extremely powerful military (especially with an ongoing civil war) is a desirable thing.

It goes without saying that the current Canadian government is accepting the Colombian government’s narrative that Colombia is a democratic, improving, stabilizing, and human-rights respecting country that is ready for foreign (Canadian) investment in order to “develop”. It’s important to note that, as Human Rights Watch has stated, the paramilitaries or “right-wing death squads” as others have called them, who are responsible for war crimes and crimes against humanity, operate like a “sixth branch of the Army”, and the Colombian army itself is often responsible for extremely egregious violations of human rights (forced disappearances, massacres, extrajudicial executions, sexual violence, etc), particularly to the civilian population it is supposedly defending. This is to whom the Canadian government thinks it is a good idea to sell guns to…..

It’s been long known that Canadian business and the Canadian government have at best been negligent to the humanitarian catastrophe of mass violence in Colombia, choosing to focus instead on promoting ‘economic growth’ through trade (which is often not unassociated). However, it now seems that, after Baird’s decision, the Canadian Military Industrial Complex will be able to directly make bank off of one of the bloodiest armed conflicts in the Western Hemisphere.

“Dear Prime Minister Harper, Minister Ablonczy, Minister Baird, and Mr. Hiebert,

I hope this message finds you all well after the holidays.

…I am an extremely concerned Canadian voter. This morning, it came to my attention that the Honourable Minister Baird, by amending the “Automatic Firearms Country Control” list, has removed the export bans on high-capacity magazines and assault weapons to my native Colombia. These same kinds of weapons are banned in Canada, as they are considered too dangerous to be on our streets. Moreover, these same kind of weapons are the ones which were used to murder over 26 innocent Americans in the Newton massacre last month.

Colombia, although much safer and less violent than in the last a decade ago, is still one of the most violent countries in the world. The homicide rate hovers at around 30-38 per 100,000, making at among the world’s 15 most violent countries. Approximately hundreds of thousands are displaced every year due to violence. Although the government is currently in promising peace talks with Colombia’s largest rebel group, the FARC, they continue to fight and terrorize local communities. This armed conflict is compounded by extremely high levels of urban violence, the ELN rebels, narcotrafficking groups, and the paramilitary successor groups or BACRIM/criminal bands which account for around a disproportionate amount of the violence in Colombia.

Colombia over the last decade has had over 200,000 murders. 75% of homicides in Colombia are committed by firearms. There are over 14,000 child soldiers in Colombia who are arguably forced to operate these kind of high-powered weapons. As per the Colombian army, it is estimated that from 2002-2006, over 3,000 young, mostly impoverished, male civilians were killed and made to look as insurgents by the Colombian army so as to increase kill counts. In Medellin a few days ago, an 11 year old girl lost her life to a stray bullet. She was only one of over 300 victims of stray bullets last year. Although Colombia is making great improvements in overcoming our violent legacy, human rights and violence are still clearly very important concerns.

I understand that in order for arms exporters to be issued a permit to export weapons under ACCFL, the government must review each case with ‘strict controls’. I also understand that Canada has been extremely generous with Colombia by making it a priority country for bilateral aid, and donating millions to support both the nascent peace process and the Land restitution law to bring growth and reconciliation to a country that has been too long plagued by violence.

However, given that Canada and Colombia’s relationship is, supposedly mutually beneficial, I fail to see the benefit that Colombia would attain from buying more arms during a peace process in which Colombian society is trying to turn away from guns. Gun bans have proven extremely effective in Colombia; earlier this year Bogota Mayor Gustavo Petro banned handguns in the capital city, leading to the murder rate dropping to its lowest point in 27 years. Bogota is now safer than many American inner cities.

I am therefore extremely curious as to how exactly, beyond ‘market opportunities’ for Canadian arms dealer, your government has considered that allowing the export of extremely dangerous and deadly firearms into a very violent country like Colombia, will be consistent with your policy of creating a mutually beneficial relationship with both countries.

I would be very appreciative if I could please be informed as to your government’s rationale for adding Colombia to the AFCCL.

Please do not conflate ‘market opportunities’ for Canadians with the re-militarization of Colombian society; if this is not the case, then please inform me otherwise.”

FARC agreement: Colombia´s history of violence and failed agrarian reform

This is part two of three looking at last week’s so-called “historic” Agrarian Reform agreement between the FARC-EP and the Colombian  government as part of Peace talks in Havana. Colombia´s government has signed an agreement with FARC guerrillas for agrarian or rural reform as part of the peace process currently underway in Havana.

On Tuesday I looked at the detail behind this accord, today I turn to history for the lessons we can learn from failed attempts at land reform in Colombia.

Colombia´s land; in the hands of the few, not the many

Like in many other Latin American countries, or post-colonial oligarchies/plutocracies, the wealth that comes from the land has been violently concentrated through different processes (genocide of indigenous peoples, colonialism, the encomienda system, agrarian reforms gone awry, free trade agreements/neoliberalism, and of course armed counter-agrarian reform/socio-political violence) for the last 500 years or so.

For historical reasons and due to the armed violence, however, Colombian rural inequality is particularly stark. 

An astounding 52% of the land is owned by 1.15% of the population. The rural GINI coefficient (the standard measure for inequality among economists) is 0.85 (where a 1 means complete inequality/where one person owns everything). Only a fifth of the potentially productive land is actually being put to use.

Colombia is by no means a naturally unequal place. So, how did we get to to this point?

I don’t want to give a history lesson, but I think Sunday’s agreement between the FARC and the Santos Government is not just a deal within it itself, but represents a significant shift in a process of popular (often armed) mobilization for agrarian reform, and counter-mobilization and concentration by the elite.

This process refers not only to Colombia´s current violence (the 49 year long war and humanitarian disaster) but also a defining aspect of the entire way the nation has been organized since the encomienda.

The history of land concentration

Initially, land was organized around the idea of owning the land that one worked (or had workers on). Later, Spanish colonial government allowed private buyers to purchase government estates, and in 1821, the government allowed the direct transfer of public land into private hands.

Under the colonial regime, land belonging to the Church or to indigenous communities was nominally protected from colonization. However, these rights were abolished for indigenous reserves in 1810, and for the Church later on.

The legalization/formalization of uncultivated public land (baldios) was handled by a government who was (much like today’s Colombia) run exclusively by the elite, leading to the creation of even more large estates for the wealthy.

Land, as a way of avoiding taxes, fighting inflation, and building credit, made it an asset which was more valuable than just what it was able to produce, making it (like in most places) one of the most coveted assets by the elites, leaving little for the landless/popular classes.

The colonization of the Colombian territory saw small-scale peasant farmers pushed off their land, forced to move into more marginal areas which they would then make productive. The landed elites would then (often forcibly) push them off of this land, and in the process expanding their territory and further consolidating its ownership.

The peasants, now landless, would move deeper into the jungle/territory/mountains looking for land. This process to a certain extent still occurs today.

A peasants´ revolt?

By the 1920s, peasants organized themselves and went on the offensive. The elites in turn responded with more displacement. This social conflict resulted in the Agrarian Reform of 1936, which because of faulty implementation (and Colombia being a Plutocracy), resulted in the formalization of property again benefiting the elites.

The Landed Oligarchy, sick of having to deal with subversive peasants, also looked for ways of making the land productive by having more capital than labour, leading to the rise of cattle-ranching.

The class warfare was only exacerbated by La Violencia  the civil war between the two political factions representing different sectors of the elite (the Liberals and the Conservatives). Forced displacement became an extremely common practice, and the standard method for resolving disputes over land given the general absence of the state in many rural or peripheral areas of the national territory.

In response to this crisis, in 1961 President Carlos Lleras Restrepo attempted a land reform through Law 135. Nevertheless, again, formalization and the granting of public land led to more concentration.

Only 1 per cent of the land was expropriated from the elite, and most of what was expropriated was poor or low-quality land. Ironically, as the government was promoting land reform, it was simultaneously giving large land owners the benefit of subsidies and tax incentives to increase production, increasing the value of their land, and making expropriation more difficult.

Rise of the narco-bourgeousie

From the 1970s to 1984, the rise of the “narco-bourgeousie” and their desire for land led to the decomposition of large estates, and the consolidation of medium-sized ones.

But while the armed counter-agrarian reform of the expansion of paramilitarism, as well as the booming cocaine industry which laundered much of its wealth in large estates reversed this trend, it also introduced drug trafficking into the historical trend of violent conflict between peasants and landed oligarchs.

In 1994, President Cesar Gaviria Trujillo tried another land reform with Law 160. Instead of focusing on formalization or expropriating land from the elite and redistributing it to the peasantry, however, it worked on the transfer of property through market mechanisms, where by the government would supposedly subsidize 70% of land bought by peasants from land owners.

However, as is evidenced by the case of the women of the Enchanted Valley, a group of displaced women who tried to purchase some land through this scheme and are now not only menaced by armed groups but also by debt collectors, the deal was only real in the halls of power in Bogota.

Paramilitarism resulted in the violent expropriation of 1.8 million hectares of land, or 2.5 times more land that had been re-distributed through the latest agrarian reform.

How different will the FARC, Santos Government reform be? 

The Agrarian Reform thrashed out in Havana runs the risk of not being very different from previous failures. This is particularly true of  how the process of “formalizing” land title (as the current agreement with the FARC seeks to do) usually is used by rural elites for their favour, and not for landless peasants.

But this reform forms part of a larger peace deal which is suppose to be transformative for Colombian society, and so the stakes are higher.

Have Paramilitaries entered where the state hasn´t bothered to go? 

Sure the “New Colombian Countryside” deal sounds promising, but will it run the same risk as the 2011 Victim’s Law (Law 1488)?

Countless courageous community leaders in places like El Choco and Cordoba have been threatened or murdered by neo-paramilitary groups simply for advocating for their land rights.

In Cordoba, there is even a neo-paramilitary group that has deemed itself the “Anti-Restitution Army“.

This resurgence of armed agrarian counter-reform (or perhaps, a consolidation that already took place during the height of the AUC paramilitaries), shows that when it comes to land in “The Other Colombia”, not much has changed in 100 or even 200 years.

The government´s apparently noble policy of trying to help the most disenfranchised in Colombian society is fine, but both the fact that the State is co-opted by the elite, and that the state has no little to no legitimate presence beyond the military in “The Other Colombia”, means it has neither the mandate, authority, or capacity to carry out these reforms.

The State can’t re-distribute land in places it has never bothered to show up for.

Bojayá: Forgotten by Urbanity, Remembered by the community.

The final part of the three part series on the 11th anniversary of the massacre/Genocide of Bojayá published at Colombia Politics.

Bojayá, Chocó: The forgotten Colombia

The communities of Bojayá, in Chocó, and Afro-descendent and indigenous peoples more generally, still face serious challenges and oppressions by the Colombian state, armed actors, and multinational corporations.

Chocó continues to be a FARC, ELN, and (neo-)paramilitary stronghold where groups fight over gold, land for agribusiness, drug trafficking routes, and the obedience of the population living on the rich land.

It is still a central point for the conflict, and produces a disproportionate amount of displacements; most displaced chocoanos end up in Quibdó, or in Medellín where they experience the additional issue of systematic racism and discrimination against people who are rural, chocoano, or displaced.

Chocó is ironically one of the richest areas of Colombia in terms of resources and since the 80s has been the apple of the eye of forestry, agribusiness, but especially mining companies.  Conflict between the communities and multinationals like AngloGold Ashanti has encouraged President Santos to rethink the mining codes.

Chocó also has some of Colombia´s worst indicators in terms of development. Literacy rates a relatively poor, and poverty is over 60%. In the Atrato region, 95% of the population has basic unsatisfied needs, according to government figures.

All these challenges are taken on by the organizations which promote the rights of the indigenous, Afro-Colombian, and displaced populations of Chocó.

These groups include  the “Association of the Displaced People of the 2nd of May (ADOM)”, the “Diocesis of Quibdó” which works through the Comission for Life, Justice, and Peace, “The Regional Organization for the Emberá-Wounaan or OREWA, the “Association of the Indigenous Chiefs of Emberá, Wounaan, Katió, Chamí and Tule” or ASOREWA, and the “Major Community Council of the Integral Peasant Association of the Atrato” or COCOMACIA who have their roots in the struggles for protecting the land against large forestry companies in the 1980s.

These groups do their work despite threats by armed groups.

What does Bojayá mean for Colombia?

We talk of Bojayá as if it were our crisis and the FARC were our terrorists who we must defeat.

And although the story of Bojayá is similar to that of much of Colombia in which local communities and their ways of life are disturbed and uprooted by national dynamics – who are not interested in them but only in what their suffering can get them-  we must understand that although we are all Colombian or even human, there are significant racial, class, rural/urban, and cultural divisions which means that we cannot appropriate the voice or the suffering of the people of Bojayá.

The people of Bojayá have been mistreated and exploited through a process of objectification and silencing since colonization – first they were under the thumb of the colonizers, then the national government who only wishes to extract their riches or speak for their community as part of its counterinsurgency or reparations plans, and now it is menaced by armed groups and multinationals.

The question is whether, when we commemorate the massacre (as we did last week), we allow the community space in which it can be heard on its own terms – or whether the urban, modern Colombia is forced to remember the other, rural (and largely ignored) Colombia only on important anniversaries, when a show can be made?

Bojayá massacre, Uribe and Plan Colombia

The massacre of Bojayá represented a low point in war in terms of mistreatment of the civilian population in Colombia, but its horror marks an important moment in the nation´s recent political history ocurring at a turning point in the battle against the FARC guerrillas.

The genocide occurred in May 2002, while in February the then President, Andrés Pastrana Arango had called off the four year long peace talks with the FARC, citing a lack of political will on behalf of the guerrillas,

The tragic events in Bojayá occurred during an election campaign in which a fringe-candidate with a “mano dura”/hardline law-and-order agenda, Álvaro Uribe Vélez, emerged on the national stage. The massacre served as political fodder for the then candidate to further paint the FARC as genocidal narcoterrorists needing to be militarily defeated.

Uribe later won the 2002 elections in the first round/without needing a run-off, an historic first in Colombian politics. As President, Uribe (and Pastrana as well beforehand) used the genocide as part of a campaign to get the FARC on “terrorist” lists in the European Union, the United States, Canada and other countries so as to legitimate a military rather than a political solution to end the armed conflict.

Meanwhile, in 1999 Andrés Pastrana had negotiated with Bill Clinton a multi-billion dollar aid package which, although partially focusing on economic development, was mostly military aid. The deal, which was at first framed around fighting narcotrafficking and the War on Drugs was known as “Plan Colombia” and made Colombia the no. 2 recipient of US military aid in the world, behind Turkey.

Following the attacks of September 11th 2001, and after the genocide and the election of Uribe in 2002, the Plan Colombia money was used also to fight the FARC and was seen as a strange convergence between the interests of the War on Drugs and the War on Terror.

Plan Colombia funcs were used to professionalize the army, leading to an historic high in military spending, known domestically as “Plan Patriota”/the Patriot Plan. This plan expanded the presence of the Army into the most marginal and peripheral areas of Colombia in order to fight the guerrillas. The knock on effect of this expansion was to  increase – rather than reduce – violence in the Chocó region in subsequent years.

As Plan Colombia was rolled out, concern grew within the State Department and the US Congress about links between the Colombian Army and the Paramilitary AUC who fought against the FARC.

Survivors´ voices ignored, or forgotten?

Uribe had been warned of the US distaste, and in response, as part of a “reparations” package, constructed ‘The New Bellavista’ (a new church and housing development). All this was done to a more modern and western style, totally foreign to the Afro-Colombian tradition of the local population. And strangely when inaugurating the “New Bellavista”, President Uribe gave his speech exclusively in English.

Many community members (whose language is of course Spanish), felt that the government was using Bellavista – as a community and a project to “show off” as part of its reparations agenda. An affront then, that it seemed as though the government was directing its initiatives to improving its international image and not the people who had actually been affected by the massacre.

Worse still, many of the economic aid projects established by the government and the NGOs were seen as unsustainable; creating dependency rather than development. All of the initiatives in ‘New Bellavista’ were considered by the displaced population in Quibdó to ignore their needs.

Last year, as the 10th anniversary of the massacre was marked, much attention was given to how the community still lacks a medical centre and other basic needs. This, despite the Constitutional Court having declared the community entitled to such investment as part of the reparation package. So, 11 years on and the community stills appears forgotten, the victims of the war not properly attended to, or represented.

There is, too, very little comfort to be taken from the way in which justice has been dealt. 36 members of the FARC-EP, including members of the Secretariat, have been involved in judicial processes concerning the massacre, but only 8 have been convicted. No charges have been brought before the AUC paramilitaries, and least of all now given the legal benefits afforded to them as part of their 2003-2006 demobilization.

The Genocide of Bojayá: 11 years of impunity

This was a guest-post I did for Colombia Politics on the 11th anniversary of the massacre of Bojayá. The first in a three part series. The majority of my research for it came from the amazing work on Historical Memory dune by the Grupo de Memoria Histórica and their report, “La Massacre de Bojayá: La Guerra Sin Límites”/”The Massacre of Bojayá: The War Without Limits”. Thursday marked the 11th anniversary of the massacre of Bojayá in Chocó, Colombia. Anywhere from 79 people, the majority of whom were minors, were killed when the Armed Revolutionary Forces of Colombia (FARC-EP), the Marxist guerrillas, launched an explosive into a church in the community of Bellavista where 300 people were seeking protection from a battle between the revolutionaries and the paramilitaries.

Every year, chocoano communities commemorate the massacre, and use it as a space to advocate for their rights facing current challenges of poverty and marginalization. For the tenth anniversary of the massacre, it was all over the media, yet this year, there is scant word from any of the nation’s major newspapers including El Tiempo, El Espectador, Semana, etc.

This massacre had huge implications in national politics, Colombia’s image abroad, its relationship with the United States, and most importantly, it evidences the huge gap between ‘The Two Colombias’, and how one promises reparation, and the other is still waiting for it 11 years after one of the country’s worst tragedies.

The massacre bears not only memorializing, but also understanding as it is a microcosm for state abandonment, and the interests and dynamics of how paramilitarism and the guerrillas work within peripheral, marginalized, underdeveloped, and overexploited regions of Colombia like Chocó.

bojaya2The FARC shot the cylinder-bomb which exploded in the church, allegedly, because the counter-revolutionary paramilitaries were using the church as a human shield during the combat. Many of the civilians fled into the church given that it was the only concrete structure in the town where people could be protected during the armed confrontations between different armed groups. Apparently, the order to shoot the cylinder-bomb came from as high as members of the Secretariat (who some analysts now say they would like to see in Congress instead of continuing in the armed struggle), and the decision to use this illegal and non-conventional weapon was made despite the fact that the weapon is made for static objects, and the paramilitaries were moving.

In other words, it was quite clear to many powerful leaders within the FARC the tremendous danger that using this weapon posed for the civilians caught in the crossfire.

Despite many early warnings by the UN, and a variety of NGOs, it seems that the Colombian Army was complicit in allowing the incursion of paramilitaries in the territory that set off a several day long armed confrontation in the Middle Atrato region of Chocó which eventually culminated in the massacre.

The Colombian government refused to acknowledge its responsibility. The FARC-EP say that it was an “unfortunate accident” and it blamed the paras for using the civilian population as a human shield. The government and the paras said that this proves the ‘barbarity’ of the ‘narcoterrorists’.

The use of the improvised explosive, or pipeta in Spanish, constitutes the use of irregular weapons by the FARC and is therefore a war crime and potentially a crime against humanity. Amnesty International, Human Rights Watch, and other international NGOs as well as Colombian ones have condemned the FARC’s use of the weapon as such.

The massacre, and combat between guerrillas and paramilitaries which had begun in late April of that year, are part of a much larger trend in which Chocó has become a focal point for the armed conflict since 1997.

The war over the Middle Atrato can be considered as a continuation of the war for Urabá. After the federation of paramilitary groups into the United Self-Defense Forces of Colombia (las Autodefensas Unidas de Colombia or AUC) in 1997, paramilitary groups tried to take the Atrato region of Chocó as it was a key corridor for moving drugs, arms, and people from the Urabá region and the Caribbean coast (which by the 90s had become a paramilitary stronghold) into the Pacific region of the country.

Previous expansions of the counterinsurgency in the territory such as the Cacarica and Genesis Operations in 1997 have been linked to the expansion of agribusinesses such as the mono-cultivation of African Palm Oil.

At the same time, the strategic corridor and lack of state presence in Chocó also makes it a very coveted territory by the guerrillas.

The massacre can be seen as part of a much larger pattern of the insurgents taking over the territory, then the counterinsurgents, then the insurgents…

This left, and continues to leave, the people of chocoano communities in a state of vulnerability as the presence of one armed group or the army provokes reprisals and suspicions from the other side.

However, the communities in Chocó were anything but passive objects in the crossfire; since 1999, communities such as Bellavista, have declared themselves ‘Peace Communities’ (Comunidades de Paz) and they have rejected the presence of all armed groups, including even at times the Colombian Army itself.

The massacre led to mass displacements of 5,700 people, and consequently a cultural alienation for the predominantly Afro-Colombian communities affected, who had to leave their traditional territory.

Many of the survivors had to flee the town of Bellavista immediately after the bomb exploded. Many have yet to return to the community, some only returned 8-10 years later. Many of the community’s practices of saying farewell to the dead were unable to occur, leaving a lack of spiritual closure.

Survivors of the massacre however, are not victims. 11 years on and that the community continues to wait for the reparations it is entitled to, and justice in terms of recognizing the complicity of ALL armed actors. The community has, though, organized in several civil-society groups and continues to demand this justice, reparation, and memory.

Many members in the community see the massacre as genocide and a continuation of their historical  displacement from Africa; many consider the battles over their territories as ongoing colonialism.

La Histórica Marcha para la paz – sus intereses, su significado, el precio de la paz, y sus excluidos

Hoy día en las calles de Bogotá millones de cuerpos colombianos se salieron a las calles, diciendo que ya no quieren mas amenazas a la integridad y seguridad de los mismos cuerpos. Estos cuerpos, despues de 49 años de asesinatos, masacres, lesiones, minas antipersonas, despariciones forzadas, reclutamientos forzados, desplazamientos forzados, violaciones, torturas, secuestros, bombas, y amenazas, quieren traer a la realidad el sueño de una Colombia en paz en vez de una en guerra contra los subversivos.

La marcha fue inicialmente organizada por La Marcha Patriotica y Colombianas y Colombianos por la Paz, liderados por la ex-senadora y auto-denominada defensora de derechos humanos, Piedad Córdoba. Esta fue una movilización pacifica en favor del actual proceso de paz entre el gobierno colombiano y la mayor insurgencia en el país, las FARC-EP.

La movilización se esta realizando en el símbolico 9 de avril, el día nacional de memoria y solidaridad con las víctimas, y el anniversario del asesinato del caudillo Libéral, Jorge Eliecer Gaitán Ayalo que desató el periodo de guerra llamado “La Violencia”.

Algunos medios estan hablando de que asistieron diez de miles a la marcha en solo la plaza de bolivar; otros, especialmente en las redes sociales, ponen la cifra de asistentes en mas de un millón solo en la capital.

En un sentido, esta marcha se puede considerar como histórica en que muestra un completo cambio de tono de las movilizaciones. Hace solo 5 años, la marcha ‘histórica’ fue la del Sr Oscar Morales quien a traves de Facebook organizó la campaña de “Un Millón de Voces Contra Las FARC” que movilizó, por la primera vez en años, millones de colombianos en contra de ese grupo armado. Sin embargo, esta marcha fue fuertemente críticada por su parcialidad (tapando los crímenes de los paramilitares y las Fuerzas Armadas) y por validar el discurso guerrerista y anti-guerrillero del establecimiento político y su contrainsurgencia. Vale resaltar que el ex-Presidente Uribe apoyo esta marcha y sus objetivos.

Ahora, se habla de una marcha pacifica en contra de la guerra y por la paz, organizada por unas entidades que son por nada non-controversiales (la ex-senadora y la Marcha Patriotica han sido acusadas de tener vinculos con la insurgencia marxista). Sin embargo, el país en esta ocasión parece unirse en una marcha multidinaria, sin importar las diferencias sociales y políticas de los participantes, en contraste a la marche de hace cinco años que estaba mas explicitamente ligada a intereses políticos particulares.

Aunque fue organizada por estos seres que todavia tienen una posición ambigua y controversial en el imaginario público, la marcha y su gesto para la paz fue bien recibida por muchos sectores del pensamiento corriente – el propio Presidente de la República, Juan Manuel Santos Calderón, invitó a los colombianos a marchar. El Partido de la U tambien ha estado en favor, y el alcalde de Bogotá, Gustavo Petro tambien llamo con mucha pasión a los colombianos a unirse a este gesto de solidaridad con las víctimas. Hasta los medios corrientes también domestraron su apoyo para la marcha.

Mejor dicho, los manifestantes de la MP quienes vinieron de todas las partes del país, muchos de ‘la Otra Colombia’, invitaron a la Colombia urbana y de clase media a temporaneamente olvidar sus divisones sociales y marchar por una paz común. Y la invitación, inesperadamente, fue bien recibida por la sociedad urbana que hace pocos años estaba marchando en pro de la contrainsurgencia.

Yo creo que la reflexión del editor de la Revista Semana mejor describe el momento político que ocurrió hoy:

En este sentido, quizá la principal lección del 9 de abril no es simplemente que el gobierno logró un importante apoyo callejero y popular a su política de negociación, sino que colombianos de orillas muy distintas, incluso enfrentadas, lograron coincidir por un día, en completa calma, en torno a un objetivo común. Pasada la marcha, por supuesto, las diferencias seguirán. Pero hay muy pocos precedentes de una alianza que vaya de lo más granado del establecimiento hasta lo más ‘duro’ de la izquierda a favor de la paz y la solución negociada. Hasta las Farc y el Eln dieron su apoyo a la manifestación.

Sin embargo, la marcha para la paz, irónicamente, pese a su caracter unificador, también resaltó las profundas divisones sociales y políticas que el proceso a agujido. Oponentes a la marcha incluyeron la rara combinación del Polo Demócratico Alternativo (aunque el congresista Ivan Cepeda y Gustavo Petro asistieron), y por supuesto, el ex-Presidente Uribe y su Puro Centro Demócratico. Los izquerdistas, por su parte, no quieren legitimizar una supuesta politicización del proceso usado por el Presidente Santos para su reelección.  Los uribistas, consideran que negociar con el grupo armado es legitimizarlo y que el proceso esta negociando ‘temas de nación’ con un grupo de ‘narcoterroristas’. En particular, el expresidente a traves de su radio-periodico de Twitter trato a la marcha de un ‘irrespeto’ para las víctimas de la insurgencia.

La marcha tiene bastantes apuestas políticas como lo contó La Silla Vacía- primero que todo, legitimizó, parcialmente, a la Marcha Patriotica y a la ex-Senadora. También, aunque Santos no marcho hasta la Plaza de Bolivar (como lo dijo el editor de Semana, ‘no hubo foto del Presidente con la ex-Senadora’), se puede ver facilmente como la Marcha le esta dando al Presidente una gran ayuda en lograr el ‘mandato’ popular para la negociación del cual le reclamaba el ex-Presidente Andrés Pastrana en su crítica del proceso.

Todo en este mundo, y mucho más en Colombia, tiene interéses particulares – la paz de Colombia debe ser para todos los colombianos, multidinaria, como fue la marcha de hoy. La paz no le debe corresponder a ningún partido político ni ningún mandatario, pero como algunos del Polo han señalado, esto no es el caso.

De el mismo sentido, tenemos que interrogar: esta marcha, y esta paz, es de quien y para quien? Los que ahora estan sentados en la mesa en La Habana discutiendo el comienzo del fin del largo y sangriente conflicto social y armado colombiano son generales, representantes del gobierno casi exclusivamente bogotanos, y no una representación amplia de quienes tienen  mayor interés en una desmovilización de las FARC-EP (los residentes de las comunidades bajo su dominio). De otra parte, no son los miles de soldados menores de edad ni víctimas de las FARC-EP que tienen su silla en la mesa, pero Iván Marquéz, el no. 2 de esta organización guerrillera y el líder del Bloque Caribe quien ha sido acusado de varios crímenes de guerra.

Mejor dicho, lo que se esta negociando en La Habana es una paz entre victimarios. Tanto el gobierno como la guerrilla se creen las víctimas, y ningunos (aunque Timochenko si se pronunció sobre esto despues de la restitución de tierras por el gobierno colombiano en el Caguán) se han comprometido a darle la cara a sus víctimas.

Esta falta de reconocimiento de sus crímenes (de ambas partas) en PRO de la paz, es muy diferente al discurso de memoria y exigencia a la verdad y la justicia que caracterizó mucho de los mensajes vistos hoy por las calles de Colombia.

No digo que lo perfecto sea el enemigo de lo bueno, pero se tiene que reconocer que como todo en Colombia, este proceso se ha dado a una centralización y burocratización; quitandole el poder y la palabra a los líderes comunitarios y los que siguen viviendo la guerra. Como lo dicen los analistas del CINEP/PP un proceso duradero y legítimo tiene que ser regionalizado. 

El enfoco gubernamental sobre la prudencia (que los guerrilleros también han respetado) hace mucho sentido dado la caotíca naturaleza del Caguán. Se ha hablado en unos sectores de someter el acuerdo a una asamblea constituyente, o un referendo popular (que, por supuesta, podria ser derrotado por el uribismo). Sin embargo, daría mucha pena si la paz, como fue la paz coja del 58 que acabó con la ‘Violencia’ pero abrió el camino para las FARC, sería como la guerra en este país – impuesta por los poderesos sobre ‘la Otra Colombia’ sin consulta ni espacio para sus voces.

Uribe y su Puro Centro Demócratico dice que el no es opositor de la paz, pero que se opone a ‘paz con impunidad‘. La diversidad en la marcha hoy quizas muestra que la mayoría de los colombianos quieren poner sus diferencias al lado y tomar ventaja de esta rara oportunidad para un acuerdo viable con una guerrilla que hace pocos años se tildaba de ‘narcoterrorista’ y hace unas decadas se pensó invencible. Sin embargo, solo porqué los Uribistas no han salido a la calle no quiere decir que no tienen apoyo, y que todas las víctimas esten a favor del proceso.

La paz, como todo en este mundo, vendrá con su precio. Las FARC-EP han dicho reitaradamente que no irán a la carcel como parte de un acuerdo. Ellos se consideran las víctimas; quieren hacer política ahora con garantias y no le quieren dar la cara a sus víctimas, ni de que hablar de cumplir castigo por sus delitos.

Entonces, se puede decir, de alguna manera, que Alvaro Uribe si tiene razón. Indudablemente, va tener que ver un compromiso entre la “justicia” y la “paz”. Muchos en la izquierda, y con buena razón, fueron muy críticos hacia el proceso de desmovilización con las Autodefensas Unidas de Colombia (AUC). Sin embargo, parece muy estraño que el vocero que les esta reclamando a las FARC-EP las víctimas sea el ex-Presidente contra-insurgente y no esta dando esa misma crítica. De todos modos, se tiene que decir que ese compromiso entre la justicia y la paz es un tema muy delicado y controversial; dentro de los medios de comunicaciones corrientes, los políticos, y la mayoria de analistas que estan a favor del proceso hay un lenguaje de llamado al perdon y la reconciliación como si las víctimas se las deben al país, pero ese compromiso (cuanta ‘justicia’ en cambio a cuanta ‘paz’) no es algo que se podrá imponer desde La Habana, ni desde Bogotá. La paz del 58 fue una paz entre victimarios, poderosos, y que fue impuesta, dejando heridas abiertas que dejaron la tierra colombiana fertil para el derramo de sangre de la proxima media decada.

Finalmente, la guerra en Colombia en muchos sentidos si y no es contra las FARC-EP. Esta guerrilla sigue desplazando, matando, amenazando, reclutando, y cometiendo todo tipo de crímenes de guerra y de lesa humanidad, pero la violencia del neoparamilitarismo es mucho más de una amenaza a la seguridad pública que las guerrillas. Esto no quiere decir que la prioridad que se da al dolor humano de las personas que siguen siendo victimizados por las FARC-EP debe ser menor por el hecho que las bandas emergentes son mas violentas, pero si quiere decir que un acuerdo de paz con las FARC-EP (y hasta con el ELN) no acabará con la guerra y la violencia en Colombia de manera holística.

Incluso esta mañana el Presidente Santos en su Twitter reconoció la lastimosa muerte de Ever Antonio Cordero Oviedo, defensor de derechos humanos y restitución de tierras que fue recientemente asesinado en Valencia, Córdoba. Este señor es solo uno de los miles de Colombianos quienes estan siendo victimazados por esta nueva composición del paramilitarismo, y quienes, por el discurso del gobierno de que son simples ‘bandas criminales’ sin conexiones al poder regional y local, no estan recibiendo ninguna marcha hoy. Entre estos miles figuran por ejemplo, las mujeres de la Asociación  Desplazados Dos de Mayo (ADOM) en el Chocó, y las Mujeres del Valle Encantado en Córdoba.

En Colombia, el desarollo ecónomico de algunos sectores esta ligados a la guerra. La guerra es en Colombia, una especia de institución propia. Desarmar esa institución, cuyas raizes estan nexas a tantas otras instituciónes como el poder político, ecónomico, la industria militar, etc va tener un alto precio. La guerra es un negociazo, y para acabar con ella tendra que haber un cambio fundamental en la sociedad colombiana. El emperador del Etiopia, Haile Selassie, en un discurso que fue immortalizado en una canción de Bob Marley llamado guerra dice que “hasta que no haya ciudadanos de primera y de segunda clase de ninguna nación, habra guerra“.

Este proceso de paz entonces debe ser un proceso tranformativo para la sociedad colombiana. No solo de reconciliación entre víctimas, y víctimarios (dos identidades que se cruzan con frequencia), pero de un nuevo contrato social para empezar a deconstruir esa muralla que divide Las Dos Colombias. La paz contra las FARC-EP tiene que ser un proceso que no solo desata un proceso con el ELN, y el neoparamilitarismo, pero que también empieza una conversación mas amplia sobre las violencias estructurales como la pobreza, el machismo, el racismo, la desigualdad, y sobre todo el clasismo que podujieron las guerrillas.

Tendrá el país esa conversación? Hace 10 años hablar de una negociación con los ‘narcoterroristas’ era imposible, y ahora es algo apoyado generalmente. Tomó una decada de contrainsurgencia, desplazamiento, asesinato, parapolítica, y guerra total, pero por lo menos esto demuestra que los colombianos han podido cambiar de opinión, dejar de al lado el guerrerismo y el odio contra las guerrillas en favor de un supuesto bien común (una paz nacional). Pero ese cambio, como lo que vendrá, tuvo un precio.

“It’s Colombia, Not Columbia” – Positividad como propaganda?

Recientemente noté que una campaña virtual, “It’s Colombia, Not Columbia” empezada por una empresa digital, Zemora, y su vice-presidente de operaciónes, Carlos Pardo, ha conquistada las redes sociales, y la comunidad colombiana en Twitter y Facebook.

Es algo positivo, creo yo, no solo que nuestros amigos non-colombianos finalmente estarán conscientes del error ortográfico que nos molesta a todos los colombianos, pero que unos jovenes dínamicos de la nación se hayan inventado semejante campaña para rechazar los estereotipos negativos y ignorantes que por demasiado tiempo han definido el imagen internacional del país.

Mucho de lo que la campaña propone es verdad – tanto en terminos de seguridad como reducción de pobreza, en las ultimas dos decadas Colombia ha progresado bastante. Al fondo de la campaña hay una intención muy noble – mostrar el “lado bueno” de Colombia, para que nos conozcan por nuestros maginificos cantantes, artistas, escritores, y activistas por la paz embez de nuestros narcotraficantes y matones. Y, a un paso (dolorosamente) lento, Colombia si esta superando su legado negativo. La Colombia de los años 1990s y los primeros años de los 2000s tenia casi la mitad de sus habitantes viviendo en pobreza; ese numero se ha reducido hoy a un tercio. En el 2002, La organización mundial por la salud de la ONU calificó a Colombia como el país mas violento del mundo, y entre circulos diplomaticos se trataba de un “estado fallido”, hablado de la misma manera en la cual muchos se refieren a Somalia y la República Democratíca del Congo hoy. El 2012, en contraste, tuvo uno de las tasas de asesinatos mas bajas de hace 3 decadas. Tambien vale la pena notar, como el mismo Pardo explica, Medellín, la 2da ciudad del país, fue de ser la capital mundial de asesinatos en 1993 a ser votada una de las ciudades mas “innovadoras” en el 2012.

La campaña, hasta cierto punto, es muy humilde, y sensible al hecho que para demasiados de nosotros y nuestras familias, el baño de sangre que fue los 1990s y los 2000s nos ha dejado con heridas aún muy frescas. Pardo dice que el no quire “negar la realidad de Colombia ni el pasado, pero que si queremos concentrarnos en las cosas buenas”.

Problemas – Quien tiene el derecho de representar a Colombia? Quien fue el responsable por todo este “progreso”?

Sin embargo, Colombia, aún un país muy bello con un pueblo fuerte y resiliente, y con muchas cosas “positivas” que valen la pena resaltar, es todavia una sociedad racista, violenta, y sumamente desigual. Es necesario ser ultra-crítico: Cuales son las cosas “positivas” que se enfatizan? Los imagenes y cuerpos de quien son excluidos? No sorprende, que con una buena pasada por la pagina de Facebook de la campaña, solo se ve los imagenes típicos de la Colombia “avanzada” y “moderna”, con mayoritariamente cuerpos blancos y mestizo de tez europea, quienes parecen pertenecer a la global y cosmopolitana clase-media, con iPhones y todo.

La población ‘real’ del país, al contrario de lo que muchos colombianos quisieran presentar en el exterior, es un poco mas diversa. Por ejemplo, según algunas aproximaciones del PNUD, un tercio del país vive en el campo, y según organizaciónes afro como El Proceso de Comunidades Negras (PCN), hasta 20% del país se podra identificar como afrodescendiente. Colombia tambien tiene una población pequeña pero no insignificante de indigenas, quienes cuentan con ser de 3-5% de la población nacional, y tambien hay una comunidad de arabes en la costa caribe, ni de que hablar de los otros grupos etnícos y sociales que no hacen parte de mitos nacionales dominantes; me refiero a los 35% de colombianos que viven en la pobreza, el aproximado 4.6 milliones que viven en la míseria. Donde esta el lugar de esa Colombia, Colombia entera, con su bueno, su malo, y su feo en esta campaña? Por si caso, la Colombia en la cual solo mencionamos lo “positivo” es una donde no hay minorias etnícas, campesinos, gente pobre?

Ademas, esta campaña no es nada nuevo. Pardo reconoce la historia de campañas de red social anteriores que tambien han tratado de restorar el imagen dañado de la república, como ‘Un Millón de Voces Contra las FARC’ (UMVCF).

Un poco de contexto para los que se perdieron de este movimiento: En el 2008, el estudiante de ingeneria barranquillero, Oscar Morales, tras Facebook, creo la campaña UMVCF – un movimiento virtual contra la insurgencia marxista (o como algunos les dicen ‘narco-terroristas’), las Fuerzas Armadas Revolucionarias de Colombia – Ejercito del Pueblo (FARC-EP), pidiendo fin a la violencia, en particular a los secuestros. La campaña de Morales fue super exitosa, con literalmente milliones de colombianos, de todos estratos, saliendo a marchar a las calles. Morales, como ha sido documentado en la excelente crónica de la historia del Facebook por David Kirkpatrick, “The Facebook Effect”, se volvió en eje central del cuento de Mark Zuckerburg, el joven creador de Facebook y multimillionario, de que la naturaleza abierta y conectiva del FB podria traer cambio social y paz al mundo. Lo que a Pardo y a Zuckerburg les faltó mencionar es que una campaña contra un actor armado no es necesariamente una campaña para la paz. UMVF fue una especie de regalo político al discurso de demonización a la disidencia y de la “guerra contra/del terror” del ex-Presidente Alvaro Uribe Vélez, y su contrainsurgencia apoyada por los EEUU. UMVCF tambien fue muy conveniente para el estado como la campaña estaba muta sobre los abusos de la Fuerza Pública y las autodefensas/los paramilitares quienes han sido vinculado con el proyecto militar del estado colombiano.

De una manera similar, “It’s Colombia, Not Columbia” puede ser interpretada como una publicidad gratis para la agenda del gobierno nacional. Dentro de Colombia, todo el mundo conoce que el gobierno esta tratando de hacer un “marketing” profesional, y comercializar el imagen del país, con las campañas “Colombia, es pasión” y “Colombia, the only risk is wanting to say” (“Colombia, el unico riesgo es querer quedarse), todo aspirando en salir de la sombra de las guerrillas y el narcotrafico para presentar a Colombia como una opción viable para el turismo y la inversión extranjera.

Este pedazito de la entrevista en The Huffington Post con Pardo, traducido del inglés, creo que habla por si solo.

Hay algunos que dirian que Colombia no es el paraiso que la campaña esta pintando. Por ejemplo, pese a los actuales dialogos de paz, todavia las guerrillas del ELN y las FARC siguen comitiendo actos violentos, y Colombia sigue siendo el primer productor de coca en el mundo. Entonces, cuales exactamente son los cambios que ustedes quieren que el mundo vea?

Pardo: Queremos que la gente comprenda que Colombia es mucho mas de lo que se ve en los medios.  Queremos balancear el mensaje, y mostrar el lado positivo. Hoy, Colombia tiene una economía fuerte y los inversiónistas estan mirando hacia Ameríca Latina, particularmente a Colombia quien durante la crisis mundial financiera a mostrado tasas de crecimiento sostenibles. Creo que Zemora es un ejemplo de esos cambios, la gente piensa que todo lo que Colombia exporta es café, y eso es importante, pero también exportamos servicios digitales a clientes como Toyota, Nissan, BMW, Sea World”

De nuevo, Pardo no esta necesariamente equivocado – Colombia si se puede identificar como una de las economias mas fuertes de Ameríca Latina, si no del mundo, en este actual deprimiento global económico. Lo que a Pardo se le olvida mencionar, es que de acuerdo con el programa de desarollo economico del actual Presidente, Juan Manuel Santos, la extracción de los recursos naturales, y no la economia digital, sera la “locomotora” del crecimiento. Con la liberalización del comercio, y el “re-establecimiento” (violento) del estado en areas anteriormente “marginales” del campo, controladas por las guerrillas y ricas en recursos, gracias a la contrainsurgencia y la “estabilización” del país, Colombia ahora esta “open for business”/lista para la inversión. Vale notar que durante los dos periodos del Ex-Presidente Uribe, la inversión extranjera en Colombia, se triplicó.

Mi otro bello país, el Canadá, ya ha comenzado a agresivamente invertir en el sector minero coombiano, y un banco canadiense ya se apropió una de las instituciones financieras mas importantes de Colombia. Acusaciones de nexos entre la mineria, la agroindustria, y los neo-paramilitares han surgido por todos lados. Tambien tengo que mencionar como la multinacional gringa Drummond, recientemente fue responsable de un catastrofe ambiental en la costa caribe, y que los trabajadores de la mina del Cerrejón, la mina mas grande de carbón del mundo, en una de los departamentos mas indigenas y mas pobres de Colombia, La Guajira, estan en huelga pidiendo una mejor renumeración. Del otro lado, si, la pobreza se ha reducido 15% en una decada, pero el GINI, la medida de la desigualdad, casi ni se ha movido de su altura de 0.57 a su actual nivel de por ahi 0.55, haciendo que Colombia sea el país mas desigual de Ameríca Latina, despues de Bolivia y Haití, y uno de los mas desiguales del mundo.

Por decir lo menos, la inversión extranjera que parece como una motivación de esta campaña urbana, no esta sin su controversia. Se puede decir que esta inversión esta perjudicando lo maximo, y devolviendo lo menos, a aquellos quienes son invinsibles en la campaña “It’s Colombia, Not Columbia” y quienes historicamente han sido invisibilizados por la sociedad colombiana – los indigenas, gente pobre, los afro, los desplazados, la gente que vive en el campo y las regiones “periferas”.

En sintesis, ya que la paz con las FARC se acerca, los colombianos tenemos que re-conceptualizar que es “Colombia” (y como queremos que sea percibido en el exterior) para que podramos sobrepasar (pero nunca olvidar) el legado ultra-violento de la nación. Crearemos un nuevo pacto social, reconoceremos los crimenes de los poderosos, y haremos una Colombia mas diversa, mas inclusiva, (como la de la constitución del 91), y nos alejaremos de las estructuras de poder y desigualdad quienes dieron leña al fuego de la violencia en el primer plazo? O continuaremos a sostener los mismos cuentos de nación, y sistemas de desigualdad en donde algunos son escuchados, muchos callados, y las riquezas de la nación son vendidas al extranjero mas rico sin la consulta prevía de las comunidades quienes viven sobre ellas, pero en la cual baseamos a los extranjeros quienes se atreven a reconocer nuestras desgracias, o mucho peor, no saben como se escribe “Colombia”?
